Description: The purpose of Part 559 is to ensure that each place, facility, or location where class II or III gaming will occur is located on Indian lands eligible for gaming under the Indian Gaming Regulatory Act of 1988 and obtains an attestation from the tribe certifying that the construction and maintenance of the gaming facility, and the operation of that gaming, is conducted in a manner that adequately protects the environment and the public health and safety, pursuant to the Indian Gaming Regulatory Act. Join NIGC staff as we review the key components of Part 559, identify crucial timelines and required submission, discuss methods of how a tribe can best ensure and enforce its EPHS codes, application to small and charitable gaming, and review instances of non-compliance recently encountered.
