Subject: 1996 & 1997 Fee Rate; Final
The National Indian Gaming Commission (Commission) has adopted final revised annual fee rates for calendar years 1996 and 1997. The rate for 1996 is 0.5% (.005) on tier 1 revenues and .15222087% (.00152220872) on tier 2 revenues; the rate for 1997 is 0.5% (.005) on tier 1 revenues and .119107745% (.00119107745) on tier 2 revenues. These rates shall apply to all assessable gross revenues from each gaming operation under the jurisdiction of the Commission.
Enclosed is a copy of the Federal Register Notice announcing the adoption of these rates.
The NIGC had collected fees at the required rate of no less than .5% on Tier I revenues, under IGRA as then written, and had not set a lower rate for Tier II. The delay in establishing this final fee rate is due to difficulties in determining amounts actually collected and credited. Affected tribes are being contacted individually and will be provided a detailed accounting. This action by the Commission completes the adjustment of fee over collections that occurred prior to the implementation of Public Law 105-83, which was passed in 1997.
